Terms and Conditions
The following Terms and Conditions, along with your official order and payment of order constitute a Contract of Sale between you the customer and Cheapa-Blinds. Changes to these Terms and Conditions may apply from time to time however are only undertaken and enforceable with the written permission of Cheapa-Blinds.
Privacy Declaration
Cheapa-Blinds are committed to respecting the privacy of its customers. The following policy discusses how personal information received by Cheapa-Blinds will be dealt with.
Although not required by law to comply with its provisions, Cheapa-Blinds by its professionalism and commitment to its customers operate within the boundaries of the Privacy Act 1988 (also sometimes referred to as the Privacy Principles Act or the Personal Information Privacy Principles Act) in dealing with its customers.
In doing so, Cheapa-Blinds customers will have the confidence that they are dealing with a supplier committed to excellence and security of its customers private information.
Below is an overview of the Privacy Act 1988
Information Protection Principles
Cheapa-Blinds must not do anything, or engage in any practice, that contravenes any information protection principles contained in the Privacy Act. In particular Cheapa-Blinds declare that it will:
- Not collect personal information unless:
a. the information is collected for a lawful purpose that is directly related to a function or activity of the purchase AND
b. the collection of the information is reasonably necessary for that purpose
- Not collect personal information by any unlawful means
- Collect the information directly from the individual
- Make the individual to whom the information relates aware of:
a. the fact that the information is being collected AND
b. the purpose for which the information is being collected AND
c. the intended recipients of the information AND
d. whether the supply of the information by the indovodial is required by law or is voluntary, and any consequences for the individual if the information (or any part of it) is not provided AND
e. the existence of any right of access to, and correction of, the information AND
f. the name and address of the Company that is collecting the information and the Compay that is to hold the information.
- Ensure that any information collected is relevant to that purpose, is not excessive, and is accurate, up to date and complete, and that the collection of the information does not intrude on the personal affairs of the individual to whom the information relates
- Ensure that the information is kept for no longer than is necessary, that the information id disposed of securely, that the information is protected against loss, unauthorised access, use, modification or disclosure, and against all other misuse, and thatm if it is necessary for the information to be given to a person in connection with the provision of a service to the Company then everything reasonably within the power of the Company is done to precent unauthorised use of disclosure of the information
- Help an individual to ascertain whether the Company holds personal information, whether the Company holds personal information relating to them,and, if so, the nature of that information, its purpose and their entitlement to gain access to the information
- Povide the individual with access to the information
- Make appropriate amendments (whether by way of corrections, deletions or additions) to ensure that the prsonal information is accurate, and relevant, up to date, complete and not misleading
- Attach to the information, in such a manner as is capable of being read with the information, any statement provided by that individual of any amendment sought
- Notify recipients of that information of the amendments made
- Not use the information without ensuring that the information is relevant, accuratem up to date, complete and not misleading
- Not use the information for a purpose other than that for which it was collected unless;
a. the individual to whom the information relates has consented to the use of the information for that other purpose OR
b. the other purpose for which the information is used is directly related to the purpose for which the information was collected OR
c. the use of the information for that other purpose is necessary to prevent or lessen a serious and imminent threat to the life or health of the individual to whom the information relates or of another person
- Not disclose the personal information unless the disclosure is necessary to prevent or lessen a serious and imminent threat to the life or health of the individual concerned or another person
- Ensure that, if personal information is disclosed to a person or body that is a public sector agency, that the agency does not use or disclose the information for a purpose other than the purpose for which the information was given to it
For the purposes of this declaration, personal information means information or an opinion (including information or an opinion forming part of a database and whether or not recorded in a material form) about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.
For the purpose of this declaration, Company means Cheapa-Blinds Pty Ltd
Placing an Order
Orders can only be accepted by customers who have registered with Cheapa-Blinds online and who have a registered customer email and password.
Placing an order with Cheapa-Blinds is a simple as logging in, selecting your products, filling out the order form and paying for your order by one of the prescribed payment methods.
Once you have completed the order process, you will receive an email confirming your order details and payment details. You will be able to track your order at any point online by logging onto the Cheapa-Blinds website and viewing your Order History online.
By placing an order and providing payment, you are agreeing to enter into a Contract of Sale. You are also agreeing to abide by the terms and condition as identified on the Cheapa-Blinds website.
Cheapa-Blinds reserve the right to refuse service, terminate an order, remove or edit website content at their discretion.
Your order stands confirmed ONLY when you receive notification from Cheapa-Blinds confirming payment has been received.
Order Acceptance
Orders can only be accepted and paid for by persons over the legal age of 18 years. Persons under the age of 18years are referred to as ‘minors’. By placing an order with Cheapa-Blinds you are acknowledging that you are not a minor and are over the age of 18 years.
Cheapa-Blinds shall, in the event that an order is placed using a false declaration of a minor/s, have the right to recover any loss, financial or otherwise caused due to a transaction by a minor/s. The legal guardians or parents of the minor/s who place an order with Cheapa-Blinds undertake the make good any loss, financial or otherwise caused by such a transaction/s to Cheapa-Blinds.
Accepted forms of payment
Cheapa-Blinds accept payment via Visa Card, Master Card and Bank to Bank deposits. No other forms of payment are accepted.
Payment processing will begin as soon as Cheapa-Blinds have received all relevant order information.
The processing of payment for orders placed on a weekend or public holiday will commence on the next business day.
Credit card payment will only be accepted once you have confirmed you agree to the terms and conditions of sale, you acknowledge you are over 18 years of age and you are an authorised person to use the Credit Card for which details have been provided for the purpose of the order.
Upon clearance of all details, Cheapa-Blinds will email you a tax invoice which is to be used for proof of purchase.
Product Delivery
Cheapa-Blinds warrant delivering your order within 5-7 working days for Ready Made blinds and 15-20 working days for Custom Made blinds. This period shall commence from the date of issue of your tax invoice indicating clearance of funds. The estimated time of delivery excludes weekends and public holidays.
Whilst every effort is made to work within these estimated delivery periods, sometimes this is out of the control of Cheapa-Blinds. In the event that you have not received your order in the timeframe indicated, you are required to contact Cheapa-Blinds.
You can track your order online under ‘My Account’.
Orders will be delivered to the address provided for the order and as it appears on your Order Confirmation notification. In the event that your address cannot be found, you will be notified by email. In the event that there is no one there to collect your order, a calling card will be left with details of how to collect your order or arrange another delivery time. Should you agree to have your product left and not signed for, Cheapa-Blinds shall not be held liable for goods delivered under these circumstances. You will be considered to be the owner of the goods after their delivery.
In the unlikely event that the order is returned to sender, the order will not be re-despatched until a new lot of postage has been paid by the customer to cover the cost of the resend. In this instance, Cheapa-Blinds reserve the right to hold onto the order until such times as the re-dispatch postage payment has been paid. If the customer does not wish to repay for the postage for the re-despatch of the order and wishes to cancel the order, then Cheapa-Blinds shall refund the cost of the order less the cost of the original freight and an administrative fee of $50-00. Should the total order bees than the cost of the freight and administrative fee, then there will be no refund to the customer in this instance.
Changing or cancelling your order
For all products that are made to order, production normally begins the day after an order is placed. Therefore Cheapa-Blinds are happy to change or cancel orders as long as Cheapa-Blinds are contacted within one (1) business day (Monday to Friday) from the date the order was submitted to Cheapa-Blinds. Orders that are changed or cancelled after one (1) business day may incur additional charges.
Ready Made blinds not requiring resizing will generally be despatched on the same day of order. Orders cannot be changed once they have been despatched.
Freight Claim Policy
Upon receipt of your order, please be sure to inspect cartons/boxes carefully and note any immediately observed damaged to the driver.
- Do not sign for badly damaged cartons or boxes
- If you believe the cartons/boxes to be damaged but the product inside undamaged, ask the driver to give you a written copy of the order with a description of the damage
- If product is damaged, do not discard the cartons/boxes. All freight claims must be reported to Cheapa-Blinds using the claim form located in 'My Account' within two days of the original delivery date.
Returns Policy
Incorrectly filled or defective orders:
If you find that your Cheapa-Blinds order has been incorrectly filled or is defective, please contact Cheapa-Blinds immediately (within two working days of delivery receipt) using the approved issue claim form located in ‘My Account’.
Cheapa-Blinds will endeavour to rectify the situation immediately upon verification of the particular issue. Product deemed defective by a customer must be advised to Cheapa-Blinds within two working days of receipt of delivery (copies of shipping/postage documentation will be required) using the appropriate issue claim form located in ‘My Account’ on the Cheapa-Blinds website.
Upon verification of an incorrectly filled order, Cheapa-Blinds will arrange for the immediate shipment/return of required items at no cost to the customer.
Incorrect Blind Measurements provided by Customer:
Ready Made blinds bought from stock may be exchanged if they are returned within 7 days of purchase in the original, unopened and undamaged packaging, in like-new condition and accompanied by your receipt. Delivery charges apply. Customers are required to advise Cheapa-Blinds of their required exchange using the issue claim form located in ‘My Account’ on the Cheapa-Blinds website.
Items that have been customised or resized cannot be returned. Custom Made blinds are made to fit your window after you place an order. Each blind is manufactured to your unique measurements and specifications. For this reason we are only able to accept returns on orders that are incorrectly filled by Cheapa-Blinds or are defective.
Customer alters product after receiving delivery or misuses the product:
In the event that a customer chooses to alter product or have the product altered by another provider and the product is damaged and/or does not fit as a result of the alteration, or in the event that the customer misuses the product for purposes other than the intent of being a window furnishing, Cheapa-Blinds shall not be held responsible for the alteration or damages and shall not refund or replace the altered product.
Cheapa-Blinds reserves the right to charge on a time and materials basis in respect of any repairs, replacement, collection and return of the product which Cheapa-Blinds agree to carry out at the customer’s request.
Cheapa-Blinds will be entitled to debit your credit card used for the original purchase for the amount notified to you for the collection, repair/replacement and return freighting of goods prior to any action being taken, and only if the charges have been agreed to by the customer.
All defective orders (be they incorrect measurements or damaged goods) MUST be reported to Cheapa-Blinds within two working days of delivery for Cheapa-Blinds to work with the customer on rectifying the situation. If Cheapa-Blinds have not been advised of damaged or non-fitting products in line with Cheapa-Blinds Returns policy then they are not in a position to assist the customer nor can they be held accountable.
Incorrect colour choice:
The product information and photographs contained within the Cheapa-Blinds website are provided for illustrative purposes only. If you have any doubt as to the precise colour of the product you wish to order, you are strongly advised to purchase a colour sample (the cost of which is refunded against your final order) prior to making a final product purchase. In the event that a customer has placed and received their order and then decides the colour is not appropriate, an exchange or refund will only be given if a sample has been ordered first and then the final order placed based on the sample colour received. Cheapa-Blinds shall not be held responsible for colour choices made on the basis of web images (see section Colour display)
Returns received by Cheapa-Blinds from customers who have not completed the user-friendly issue claim form located in ‘My Account’ may experience delays in the processing of their returns as Cheapa-Blinds endeavours to obtain the relevant information.
Errors in your order
It is very important that you follow Cheapa-Blinds measuring and installation instructions. When you follow Cheapa-Blinds instructions Cheapa-Blinds guarantee your blinds will fit perfectly! It is equally important that you review your email order confirmation for accuracy. Of course Cheapa-Blinds realise that mistakes may occur and if Cheapa-Blinds make a mistake on your order Cheapa-Blinds will either repair or remake it at no charge to you. If you make a mistake in measuring or ordering please contact Cheapa-Blinds. Depending on the type of error you may return the product to the factory for either replacement for Ready Made Blinds or remake for Custom Made blinds. Rectification of customer errors will incur additional costs which will be confirmed with you prior to any action being taken.
Refunds
In the event that a refund is required, after investigation of a return by Cheapa-Blinds, any refund will be issued through the same payment medium in which your original purchase was made to Cheapa-Blinds.
Authorisation for any refund cannot occur until such times as the product has been returned to and received by Cheapa-Blinds along with a completed issue claim form located in ‘My Account’.
No refunds are permitted in the event that the customer is simply unhappy with their purchase or has changed their mind.
In the event of a customer refusing to pay a freight delivery charge as a result of a re-despatch and then wishing to cancel their order, Cheapa-Blinds shall refund the cost of the order less the cost of the original freight and an administrative fee of $50.00. Should the total order be ess than the cost the freight and administrative fee, there will be no refund to the customer in this instance.
GST
Goods and Services Tax (GST) is a federal tax introduced by the Australian Government. Unless otherwise mentioned on a quote, product listing or any other documentation issued by Cheapa-Blinds, all prices quoted are inclusive of GST.
Prices
All prices listed on the Cheapa-Blinds website, in quotes, invoices or any other documentation issued by Cheapa-Blinds are in Australian dollars unless otherwise stated.
Credit Card Fraud
Cheapa-Blinds have incorporated what they believe to be the safest online payment medium for their customers. Despite these best efforts, in the event that sensitive Credit Card information of a customer has been compromised, Cheapa-Blinds shall not be held responsible for any damages, consequential losses, direct or indirectly suffered by the customer. Such events can include but are not limited to computer hacking of personal computers, internet redirection of keystrokes or other incidents that are beyond the control of Cheapa-Blinds or the use of an individual’s credit card by an unauthorised person.
Export of Sales – Delivering to an overseas address
Cheapa-Blinds do not hold an exporters licence. As such the extent of any sale is confined to the political boundaries of Australia. Therefore, no customer shipment or order can or will be undertaken from an offshore individual or entity.
Colour Display
Cheapa-Blinds engage the services of professional photographers, web design specialists and product manufacturers to ensure the best display of all products, colouring, accessories and instructions as accurately as possible. The accuracy in colour of all products displayed online is subject to the colour settings on your individual monitor. As such Cheapa-Blinds cannot guarantee that your monitors display will give you a true representation of product colours.
Product Samples
Cheapa-Blinds make every reasonable effort to ensure the colours shown on the Cheapa-Blinds website accurately match the products sold by Cheapa-Blinds. However, there may be some differences in actual colour due to differences in computer systems and colour monitors. Some textures may not be clearly visible. Natural products like wood and bamboo have a natural character and may have subtle colour differences. For the most likely accurate colour match, Cheapa-Blinds require that you order samples.
In addition, it is recommended that you order ALL your blinds of a given colour at the same time a there can be minor variations between dye lots.
Product Warranties
In addition to the manufacturer’s warranty, Cheapa-Blinds provide a 24 month (two year) warranty on products listed on the Cheapa-Blinds website from the date of original purchase unless otherwise stated.
Cheapa-Blinds warranty excludes product fading, malicious damage, misuse, product that has been removed from the original delivery address, product that has been altered or tampered with in any way from its original delivered condition.
Return of product under warranty must be arranged by the customer. All costs associated with the return of the product must in the first instance be borne by the customer until such times as Cheapa-Blinds can assess the claim. If deemed a reasonable warranty claim, Cheapa-Blinds will replace or repair the product and return by courier to the original customer.
For manufacturer warranties and in some instances manufacturers extended warranties, please refer to individual product pages.
Discontinued Products
From time to time a product or fabric may be discontinued to make way for a new product or in the event the mill no longer produces the colour or pattern. Cheapa-Blinds make every effort to keep products up to date on their website however, in the case that a product becomes discontinued; this is beyond the control of Cheapa-Blinds. Should an order be placed for a product that is discontinued, a Cheapa-Blinds Customer Service representative will contact you immediately and an alternative product may be selected or a refund for that particular product ordered given.
Back Orders
In the event that an order from a supplier is delayed, or in the event that Cheapa-Blinds may be experiencing a busier than usual period, or in the rare event that a product is placed on back order, Cheapa-Blinds will notify the customer within 24 hours with a new estimated time of delivery.
Exclusion of Liability
Cheapa-Blinds shall not be liable for any loss of income, profits, contracts, data or for any indirect or consequential loss or damage of any kind whatsoever arising, and whether caused by tort (including negligence), breach of contract or otherwise resulting from purchases made through Cheapa-Blinds.
In the event of a refund, the maximum amount for which Cheapa-Blinds undertakes liability shall under no circumstances exceed the amount paid by the customer for the product including postage and handling.
Cheapa-Blinds shall not accept liability for:
- incorrect measurement by the customer for any purchases
- incidental and or inconsequential damages as a result of purchases
- the cost of installation, removal or reinstallation of any product
Corrections and Continuous Improvement
Cheapa-Blinds pride themselves on being leaders in not only product but also on their levels of customer service. This includes the information provided to customers on product selections and purchases. Whilst endeavouring to provide accurate and up to date information, in rare instances, typographical errors and inaccuracies may occur. Cheapa-Blinds reserve the right to correct any errors, inaccuracies or omissions and to change or update information or pictures at any time without prior notice (including after you have placed your order). Possible changes may include but are not limited to product type, price, photographic depiction and availability.
Contracts of Sale
All Contracts of Sale entered into are between the customer and Cheapa-Blinds. No rights and or obligations whether in part or in whole can be assigned to a third party without the express written permission of Cheapa-Blinds. Any third party transfer without the written permission of Cheapa-Blinds shall be deemed to be null and void.
In the event that a competent authority holds part of the Terms and Conditions as laid down on this website or those deemed to form part of the Contract of Sale to be invalid or unenforceable in whole or part, the validity of the remaining Terms and Conditions shall not be affected.
Under the Trades Practices Act 1974 (“ACT”) where implied conditions and warranties cannot be excluded, any liability on Cheapa-Blinds for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) shall be limited at the option of Cheapa-Blinds to the replacement of the product/s or the re-supply of the same product/s; the payment of cost of replacing the product/s or of providing equivalent product/s. Governing disputes are covered under the state law of business registration which in the case of Cheapa-Blinds is the state of Queensland in the Commonwealth of Australia.
Terms and Use of the Cheapa-Blinds Website
The Australian owned website of Cheapa-Blinds or any portion of the Cheapa-Blinds website may not be reproduced, duplicated, copied, sold, resold, plagiarised or otherwise exploited for any commercial purposes that is not expressly permitted by Cheapa-Blinds, Diablo-Group Pty Ltd or Blinds Australia.com.au Pty Ltd.
Cheapa-Blinds reserve the right to refuse service and/or cancel orders at its discretion including, without limitation, if Cheapa-Blinds believes that customer conduct violates applicable law or is harmful to the interests of Cheapa-Blinds.
